Creative Barcode® Trust Charter Agreement©

I/we, believe that the concepts, strategic proposals, creative solutions, inherent and articulated ideas & inventions created by the likes of designers, engineers, content creators, PR professionals, marketing and brand consultants, writers, inventors, product designers, scientists, technologists, make a vital contribution to our economy and society.

I/we believe that it is essential to uphold and protect their value to ensure the continued efficient flow of solution-led creativity, ideas and innovation.

I/we therefore support equitable and ethical trading between creators and their partners/clients through the use of Creative Barcode® as a mechanism that enables disclosure of creative solutions, proposals, concepts and ideas in confidence.

As such, I/we confirm acceptance of files and correspondence from Creative Barcode® members, written or visual, to which a barcode has been applied, that are in response to a solicited invitation to a pitch, tender, support open innovation activity, meeting request, provision of information and/or our acceptance of their meeting or submission of information request. 

 I/we undertake not to disclose or commercialise any written or visual material including the core ideas inherent in strategic proposals and or visually expressed material, nor to cause, aid or abet any other person or organisation to do so without securing the written permission of the Creative Barcode® member.

I/we agree to receive barcoded files providing that the Creative Barcode® member is the producer and owner of the original concepts and is authorised to undertake disclosure.  And, on the basis that the files do not contain any commercially sensitive IP so as to affect a patent application.

The Creative Barcode® member indemnifies me against any claims arising if they purposefully submit files that do not contain their original work; or that contain others work without authorised consent to disclose or contain open source or work in the public domain without a source credit

On this basis I hereby agree to accept barcoded files from Creative Barcode® members; either via the Creative Barcode® file transfer, tracking and download system or by any other means such as a Creative Barcode® members’ own file transfer system; via upload to a confidential, non-public online web portal; by email; by post or in face to face meetings.

Intervention and Mediation support by the World Intellectual Property Organization (WIPO) Arbitration and Mediation Center

Should any dispute arise in relation to an alleged breach of Creative Barcode® terms, we recognise that resolution under the WIPO Mediation Rules would be a more appropriate and cost and time effective approach than court litigation.

We therefore pledge that if a dispute arises, we are prepared to consider resolution through WIPO mediation.
